Terms of Service

DRAFT — not legally reviewed. This document is a starting outline. It must be reviewed by a qualified attorney (German law) before being used in production.

1. Service description

The Provider operates an AI-assisted video generation service that produces reenactment videos from descriptions and reference materials supplied by the Customer. Output is generated by third-party AI models and is not a recording of real events.

3. Intellectual property

Upon full payment for a specific video, the Customer receives full rights and ownership of that delivered video file. Rights transfer per video, not per order. The Provider retains the right to use anonymized, non-identifying process data for service improvement.

4. AI disclosure requirement

The Customer is required to disclose, in all public uses of delivered videos, that the content was generated by artificial intelligence. The Customer assumes all liability for failure to disclose, including but not limited to claims based on impersonation, defamation, deception, or breach of platform rules.

5. Revision policy

Each delivered video includes one (1) revision at no additional cost. Additional revisions are billed at €15 per revision. A revision is a single regeneration with adjusted prompt or parameters; it does not include reshoots, additional reference materials, or scope changes.

6. Delivery timeline

Preview links are issued within the timeframe communicated at order acceptance. Download links remain valid for 7 days. The Customer may request link renewal up to 5 months after initial delivery.

7. Liability disclaimer

AI-generated content may deviate from the Customer's expectations or memory of the real event. The Provider is not liable for accuracy variations inherent to AI generation. Liability is otherwise limited to the order value and excludes consequential damages, except in cases of intent or gross negligence.

8. Data privacy and GDPR

Customer-supplied data (text descriptions, reference photos, contact details) is processed to fulfill the order and stored for up to 5 months after delivery. Customers may request deletion at any time via sennhenn@mail.de. Data is not shared with third parties beyond the AI model providers strictly necessary to perform the service. 9. Cancellation policy

The €100 research fee is non-refundable once generation begins. Cancellations before generation begins are refunded in full minus any payment processor fees actually charged.

10. Dispute resolution

These terms are governed by the laws of the Federal Republic of Germany. Place of jurisdiction is the Provider's registered seat, to the extent permitted by law. Mandatory consumer protection provisions remain unaffected.

11. Warranty disclaimer

Videos are delivered "as is". The Provider warrants only that delivery occurred and that files match the agreed technical specification (format, resolution, length).

12. Confidentiality

Reference materials and personal information supplied by the Customer are treated as confidential and are not used or shared beyond the scope of order fulfillment without explicit written consent.

13. Term modifications

Updates to these terms apply only to orders placed after the update is published. Material changes are communicated to existing customers by email.

14. Privacy policy summary

Controller: LiveShowCreator (full address to be inserted). Purpose: order fulfillment and customer communication. Legal basis: contract performance (Art. 6(1)(b) GDPR) and legitimate interest (Art. 6(1)(f) GDPR). Storage period: maximum 5 months after delivery, thereafter deletion subject to Provider approval. Customer rights: access, rectification, erasure, data portability, complaint to the supervisory authority. Contact for data requests: sennhenn@mail.de.
